The Madras Bench of the Central Administrative Tribunal (CAT) on Tuesday granted an interim stay on all further proceedings pursuant to a notification by the Directorate of School Education (DSE), Puducherry Government, inviting applications for the post of Trainee Physical Education Teachers on a contract basis, until further orders.
A Vacation Bench of CAT comprising Members K. Elango (J) and R. Satapathy (A) passed the order on an application by P. Saravanan of Thilaspet, Puducherry.
It ordered notice to the respondent returnable by June 9.
The applicant said he was from Puducherry and was a post-graduate in commerce and passed B.P.Ed.
The DSE issued a notification on February 10 this year calling for applications to fill up 18 posts of Trainee Physical Education Teachers.
The qualification prescribed was a degree of a recognised university with a diploma in physical education or a degree in physical education.
He applied on March 1.
He did not receive any call letter.
He said the post of Physical Education Teacher was a regular one carrying a pay-scale. It was a selection post to be filled by direct recruitment.
There was no post of Trainee Physical Education Teacher.
The vacancies notified were due to retirement of regular employees.
The posts could be filled only as per the recruitment rules on a regular basis and not on contract basis for three years on consolidated wages.
Therefore, the notification was illegal and liable to be set aside.
